HC Supervisors approve loan for jail; still waiting to award construction contract

While Henry County Supervisors un-tabled and approved a resolution accepting a proposal to purchase $9.1 million general obligation loan notes for the Law Enforcement Center, awarding construction contracts still is postponed until further notice.

Awarding construction contracts for the Law Enforcement Center was tabled Tuesday, April 23, as Supervisors scrambled to confront a lawsuit regarding the new jail served to them by Prochaska and Associates, Inc., of Omaha, Neb.

In the lawsuit, Prochaska alleges that the Board of Supervisors, Midwest Construction Consultants contractor John Hansen and Midwest Construction Consultants breached contract when Prochaska was excluded from the bidding of the Law Enforcement Center project.

While Supervisors were able to approve the loan, they are not able to move forward with approving construction contracts until litigation is completed.

Henry County Auditor Shelly Barber said that the county was still able to get the bonds at the interest rate they anticipated on Tuesday, so “we didn’t lose out there.”

In regard to litigation, Supervisor Greg Moeller said, “We’re working on our end of that.”
